A BILL to amend article twenty-two, chapter twenty-nine of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
nine-a, relating to lottery; providing for a permanent scratch
off game to benefit nursing homes for veterans; creating a
special fund; uses of moneys in the fund; appropriation by the
Legislature and setting forth effective date.
Be it enacted by the Legislature of West Virginia:
That article twenty-two, chapter twenty-nine of the code of
West Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated section
nine-a, to read as follows:
ARTICLE 22. STATE LOTTERY ACT.
§29-22-9a. Veteran's home instant lottery scratch-off game.
Beginning the first day of September, two thousand, the commission shall establish a permanent instant lottery scratch-off
game and the profits derived from this game shall be used to
construct and operate one or more nursing homes for veterans of the
armed forces of the United States military: Provided, That once
the Legislature has determined that there are sufficient nursing
homes for veterans in this state and that those nursing homes have
sufficient funds to operate, the Legislature may appropriate the
excess profits for other purposes: Provided, however, That before
any profits may be appropriated for the uses set forth herein, it
shall first be determined that the state has met all debt
obligations for which lottery profits have been pledged. This game
shall be a permanent addition to the instant lottery scratch off
games offered by the lottery and the commission shall change its
design or theme regularly so that this game remains competitive
with the other instant lottery scratch-off games offered by the
commission. The instant lottery game herein created shall be
clearly marked or identified that the profits derived therefrom are
being used for nursing homes for veterans.
NOTE: The purpose of this bill is to create a special instant
lottery game and to use the profits from this game to construct and
operate nursing homes for veterans.
